1. About the Program

Hell Yes Guest® is a self-paced digital program offered by Kelly Mosser LLC, doing business as Hell Yes Media ("Company," "we," "us"). The program provides strategic instruction to help you get booked on podcasts and grow your authority and business through podcast guesting.

2. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract to purchase or use this program. By purchasing, you represent that you meet these requirements.

3. What's Included

On August 10th, 2026, you'll receive access to:

• 8 modules of pre-recorded video training, worksheets, and templates housed on the Kajabi platform, and a tool to find podcasts, including publicly available contact information.

You will have access to the 8 Kajabi modules for the lifetime of the course (see Section 5). You will have access to the podcast database for six (6) months from the date of purchase. Access to the database will end automatically at the conclusion of this period. Renewal or extended access, if offered, will be made available for a separate fee at our discretion; we are under no obligation to offer renewal.

4. Pricing & Payment

The current sale price of Hell Yes Guest® is $397 USD, subject to change without notice for future purchasers. Payment plans are available at checkout through Klarna and Afterpay. These are third-party services with their own terms and privacy policies, which we do not control and are not responsible for. Any dispute regarding a payment plan must be resolved directly with the applicable provider.

5. Refund Policy

No refunds are available for this product. If you have concerns about the program, please contact us at support@kellymosser.com and we will do our best to make it right. Initiating a credit card chargeback or payment dispute without first contacting us is a breach of these terms and may result in immediate termination of your access.

6. Lifetime Access to Course Curriculum

You'll retain access to the 8 Kajabi modules for the lifetime of the course under Hell Yes Media. All future updates to those modules are included at no additional charge. While it is our intention to maintain the course indefinitely, we cannot guarantee uninterrupted or perpetual availability, including in the event the Kajabi platform, or a successor platform, discontinues service or we discontinue the program. We will provide reasonable advance notice before ending the course.

7. Podcast Database: Additional Disclaimers

The podcast database is provided as a research tool. We do our best to keep listings and contact information current, but we do not guarantee the accuracy, completeness, or responsiveness of any listing, and we are not responsible for outdated or incorrect information, as the tool pulls from API data that is maintained by a third party.

You are solely responsible for how you use any contact information obtained through the database, including compliance with applicable anti-spam, marketing, and data protection laws (such as the CAN-SPAM Act). We do not authorize, and expressly prohibit, use of the database for bulk, unsolicited, or automated (scraped/harvested) outreach campaigns outside the strategies taught in the program.

8. Who This Program Is Not For

Hell Yes Guest® is designed for individual business owners seeking to grow their own brand through podcast guesting. This program is not available for purchase by agencies, consultants, or strategists who intend to use its methods or the podcast database to book clients (rather than themselves) on podcasts. Anyone found using the program for this purpose will have their access revoked immediately without refund, without prejudice to any other remedies available to us.

9. Intellectual Property

"Hell Yes Guest®" and associated names, marks, and logos are trademarks of Kelly Mosser LLC. All course content, including videos, worksheets, templates, concepts, frameworks, methods, and the podcast database, is the intellectual property of Kelly Mosser and Hell Yes Media and is protected by copyright and other intellectual property laws. Upon purchase you receive a personal, non-transferable, non-exclusive, non-sublicensable license to use the materials for your own learning and implementation only.

You may not reproduce, share, sell, teach, license, distribute, scrape, or create derivative works from any course content, frameworks, or database entries, in any format, digital or physical. You may not utilize the Hell Yes Guest strategies or concepts to book guests on podcasts as part of your own commercial endeavors. You may not share your login credentials with any other individual. You may not assign or transfer your rights under these terms to any other person or entity. Violations may result in immediate access revocation without refund and legal action.

Downloading video content from the platform to personal devices is strictly prohibited. Course videos are digitally encrypted and monitored. Suspected violations will be investigated and may result in legal action.

10. No Guarantees; Disclaimer of Warranties

Hell Yes Guest® provides proven strategies and frameworks, but individual results will vary based on your starting point, the quality of your implementation, and the effort you put in. We cannot and do not guarantee specific outcomes, including any particular number of podcast bookings, audience growth, or revenue. Your results are ultimately your responsibility.

The program and podcast database are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement, to the maximum extent permitted by law.

This course is not a substitute for medical, mental health, legal, financial, or other professional advice. The course is delivered entirely in English; no translations are provided.

11. Limitation of Liability

To the maximum extent permitted by law, Kelly Mosser LLC, its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising out of or related to your purchase or use of Hell Yes Guest®. Our total aggregate liability for any claim arising out of these terms or the program will not exceed the amount you paid for the program in the twelve (12) months preceding the claim.

Nothing in these terms limits liability where such limitation is not permitted by applicable law.

12. Indemnification

You agree to indemnify and hold harmless Kelly Mosser LLC and its owners, employees, and contractors from any claims, damages, losses, or expenses arising out of your use of the program or the podcast database, your violation of these terms, or your violation of any law or third-party right, including in connection with outreach conducted using contact information obtained through the database.

13. Force Majeure

We are not liable for any delay or failure to perform our obligations under these terms resulting from causes beyond our reasonable control, including platform outages, natural disasters, acts of government, or other events of force majeure.

14. Modifications to the Program and These Terms

We may update, modify, or discontinue portions of the program (other than the core 8 Kajabi modules, per Section 6) and may revise these terms from time to time. Material changes to these terms will be communicated via email or posted with an updated effective date. Continued use of the program after changes take effect constitutes acceptance of the revised terms.

15. Termination

We may suspend or terminate your access to the program, without refund, if we reasonably believe you have violated these terms, including the restrictions in Sections 8 and 9. Sections concerning intellectual property, no guarantees, limitation of liability, indemnification, and dispute resolution survive termination.

16. Privacy

Your personal information will never be sold or shared with unrelated third parties. Payment information is processed securely by a third-party processor and is never accessible to us. You may opt out of email or SMS communications at any time by emailing support@kellymosser.com.

17. Communication

By purchasing this program you agree to receive communications related to your enrollment via email. To be removed from either channel at any time, email support@kellymosser.com.

18. Governing Law & Dispute Resolution

These terms are governed by the laws of the State of New York, without regard to conflict-of-law principles, and applicable United States federal law. Any dispute arising out of or relating to these terms or the program will be resolved exclusively in the state or federal courts located in New York, and you consent to the personal jurisdiction of those courts. 

19. General

These terms constitute the entire agreement between us regarding Hell Yes Guest®. If any provision is found to be invalid or unenforceable, the remaining terms continue in full effect. Our failure to enforce any provision of these terms is not a waiver of our right to do so later.
